Game changer: Justice Roberts switches teams

The Court?s majority, made possible by Chief Justice Roberts' surprise decision, has given a huge victory to the Obama administration and, arguably, the American people. The?Affordable Care Act is still flawed, but it is also a milestone.

Yesterday a majority of the Court upheld the constitutionality of the?Affordable Care Act, otherwise known as Obamacare in recognition of its importance as a key initiative of the Obama administration. The big surprise, for many, was the vote by the Chief Justice of the Court, John Roberts, to join with the Court?s four liberals.

Roberts? decision is not without precedent. Seventy-five years ago, another Justice Roberts ? no relation to the current Chief Justice ? made a similar switch. Justice Owen Roberts had voted with the Court?s conservative majority in a host of 5-4 decisions invalidating New Deal legislation, but in March of 1937 he suddenly switched sides and began joining with the Court?s four liberals. ?In popular lore, Roberts? switch saved the Court ? not only from Franklin D. Roosevelt?s threat to pack it with justices more amenable to the New Deal but, more importantly, from the public?s increasing perception of the Court as a partisan, political branch of government.

Chief Justice John Roberts isn?t related to his namesake but the current Roberts? move today marks a close parallel. By joining with the Court?s four liberals who have been in the minority in many important cases ? including the 2010 decision, Citizen?s United vs. Federal Election Commission, which struck down constraints on corporate political spending as being in violation of the Constitution?s First Amendment guaranteeing freedom of speech ? the current Justice Roberts may have, like his earlier namesake, saved the Court from a growing reputation for political partisanship.

As Alexander Hamilton pointed out when the Constitution was being written, the Supreme Court is the ?least dangerous branch? of government because it has neither the purse (it can?t enforce its rulings by threatening to withhold public money) nor the sword (it has no police or military to back up its decisions). It has only the trust and confidence of average citizens. If it is viewed as politically partisan, that trust is in jeopardy. As Chief Justice, Roberts has a particular responsibility to maintain and enhance that trust.

Nothing else explains John Roberts? switch ? certainly not the convoluted constitutional logic he used to arrive at his decision. On the most critical issue in the case ? whether the so-called ?individual mandate? requiring almost all Americans to purchase health insurance was a constitutionally-permissible extension of federal power under the Commerce Clause of the Constitution ? Roberts agreed with his conservative brethren that it was not.

Roberts nonetheless upheld the law because, he reasoned, the penalty to be collected by the government for non-compliance with the law is the equivalent of a tax ? and the federal government has the power to tax. By this bizarre logic, the federal government can pass all sorts of unconstitutional laws ? requiring people to sell themselves into slavery, for example ? as long as the penalty for failing to do so is considered to be a tax.

Regardless of the fragility of Roberts? logic, the Court?s majority has given a huge victory to the Obama administration and, arguably, the American people. The?Affordable Care Act is still flawed ? it doesn?t do nearly enough to control increases in healthcare costs that already constitute 18 percent of America?s Gross Domestic Product, and will soar even further as the baby boomers age ? but it is a milestone. And like many other pieces of important legislation before it ? Social Security, Medicare, Civil Rights and Voting Rights ? it will be improved upon. Every Democratic president since Franklin D. Roosevelt has sought universal health care, to no avail.

But over the next four months the Act will be a political football. Mitt Romney, the Republican presidential candidate, has vowed to repeal the law as soon as he is elected (an odd promise in that no president can change or repeal a law without a majority of the House of Representatives and sixty Senators). Romney reiterated that vow this morning, after the Supreme Court announced its decision. His campaign, and so-called independent groups that have been collecting tens of millions of dollars from Romney supporters (and Obama haters), have already launched advertising campaigns condemning the Act.

Unfortunately for President Obama ? and for Chief Justice Roberts, to the extent his aim in joining with the Court?s four liberals was to reduce the public appearance of the Court?s political partisanship ? the four conservatives on the Court, all appointed by Republican presidents, were fiercely united in their view that the entire Act is unconstitutional. Their view will surely become part of the Romney campaign.

PITTSBURGH-- A new study led by University of Pittsburgh researchers reveals that moderate amounts of alcohol--consumed in a social setting--can enhance positive emotions and social bonding and relieve negative emotions among those drinking.

While it is usually taken for granted that people drink to reduce stress and enhance positive feelings, many studies have shown that alcohol consumption has an opposite effect. In a new paper titled "Alcohol and Group Formation: A Multimodal Investigation of the Effects of Alcohol on Emotion and Social Bonding," research shows that moderate doses of alcohol have a powerful effect on both male and female social drinkers when they are in a group.

The paper will be published in Psychological Science, a journal of the Association for Psychological Science.

According to the researchers, previous alcohol studies testing the impact of alcohol on emotions involved social drinkers consuming alcohol in isolation rather than in groups.

"Those studies may have failed to create realistic conditions for studying this highly social drug," said Michael A. Sayette, lead author and professor of psychology in Pitt's Kenneth P. Dietrich School of Arts and Sciences. "We felt that many of the most significant effects of alcohol would more likely be revealed in an experiment using a social setting."

Sayette and his colleagues assembled various small groups using 720 male and female participants, a larger sample than in previous alcohol studies. Researchers assessed individual and group interactions using the Facial Action Coding System (FACS) and the Grouptalk model for speech behavior.

They concluded that alcohol stimulates social bonding, increases the amount of time people spend talking to one another, and reduces displays of negative emotions. According to Sayette, the paper introduces into the alcohol literature new measures of facial expression and speech behavior that offer a sensitive and comprehensive assessment of social bonding.

Sayette and eight colleagues took special care in the methods they employed to form the groups. Each participant was randomly assigned to a group of three unacquainted "strangers." Each group was instructed to drink an alcoholic beverage, a placebo, or a nonalcoholic control beverage. Twenty groups representing each gender composition (three males; one female and two males; two males and one female; and three females) were assigned to the three different beverage scenarios. Group members sat around a circular table and consumed three drinks over a 36-minute time span. Each session was video recorded, and the duration and sequence of the participants' facial and speech behaviors were systematically coded frame by frame.

Results showed that alcohol not only increased the frequency of "true" smiles, but also enhanced the coordination of these smiles. In other words, alcohol enhanced the likelihood of "golden moments," with groups provided alcohol being more likely than those offered nonalcoholic beverages to have all three group members smile simultaneously. Participants in alcohol-drinking groups also likely reported greater social bonding than did the nonalcohol-drinking groups and were more likely to have all three members stay involved in the discussion.

"By demonstrating the sensitivity of our group formation paradigm for studying the rewarding effects of alcohol," said Sayette, "we can begin to ask questions of great interest to alcohol researchersWhy does alcohol make us feel better in group settings? Is there evidence to suggest a particular participant may be vulnerable to developing a problem with alcohol?"

The new research sets the stage for evaluation of potential associations between socioemotional responses to alcohol and individual differences in personality, family history of alcoholism, and genetic vulnerability.

Additional Pitt researchers on the project were Pitt graduate students in psychology Kasey Creswell, John Dimoff, and Catharine Fairbairn and professors of psychology Jeffrey Cohn, John Levine, and Richard Moreland. Other researchers included Bryan Heckman, a graduate student in psychology at the University of South Florida, and Thomas Kirchner, a research investigator at the Schroeder Institute for Tobacco Research and Policy Studies.

The study was funded by a grant from the National Institute on Alcohol Abuse and Alcoholism.

Sleek & lightweight for discretion & convenience

Two new products from Motorola Solutions meet the customer brief for a

lightweight product with a sleek and stylish appearance, combined

with rugged performance.

?

MOTOTRBO SL Series digital radio

To develop the MOTOTRBO SL Series, Bruce Claxton, Motorola Solutions senior director of design innovation, travelled the globe to listen to customers. The response was demand for a product that had style, refinement and a premium look. Most importantly, it had to be smaller than anything Motorola Solutions had ever done before.

The result is the incredibly thin and light ? it weighs as little as your average smartphone ? MOTOTRBO SL 7550 portable radio, the ultimate in discreet communications. Versatile and powerful, this device is designed to meet communication needs in the hospitality, services, security and airport industries.

With advanced features such as Intelligent Audio, integrated Bluetooth and covert mode, end-users can provide superior customer service and faster response times, discreetly and professionally.

Russell Penton, security and health and safety officer at Claridge?s Hotel in London, agrees: ?The radio needs to be small so that it?s not obvious to any of our guests that I?m wearing a radio, and also because we do such long shifts. We do 12 hours plus on our shifts. The more comfortable and lightweight the radio is, it?s of benefit to us as an end-user, definitely ? The new radios themselves are quite a leap forward. It?s the biggest step forward that I?ve seen in my years as a radio user.?

Ruby Mountain, receptionist at Claridge?s Hotel, concludes: ?The MOTOTRBO SL Series is fantastic. It?s really lightweight, it?s very easy to use. A lot of the times when we communicate with the luggage porters ? the guests are actually standing in front of us, so it?s difficult to do in a subtle way. But the SL Series really helps with that because it?s very small and it?s very convenient.?

CLP analogue portable radio

CLP, the latest business class two-way radio is here! The CLP solves those common user complaints of two-way radios getting in the way, being too uncomfortable to carry all day long, or that users have no place to attach them.

Designed specifically for retail, hospitality, and restaurant environments, the CLP is small and lightweight. Minimal training is required with a simple one-button, push-to-talk operation. Clear, strong audio makes communicating easy even in the noisiest restaurant. The design is sleek and contemporary, yet durable, and the long battery life will stand up to the everyday wear and tear of any fast-paced business.

Flexible carry options include a belt or lanyard to match the workplace environment. A unique magnetic clothing mount even enables attachment, such as on a lapel, apron, shirt or uniform, for those whose business attire precludes a belt.

The All-Purpose Writer ? The Brimmer Files

(Jason Miller)

On Tuesday night I e-mailed the link to Siobhan Hunter?s review of Last Summer at the Marmont to the author of Q, knowing he would particularly enjoy it since he lived at the Chateau Marmont for a spell during the 1970s when he was a Hollywood screenwriter and script doctor. In the e-mail I also apologized for not meeting the self-imposed deadline of June 16 for the new draft of the screenplay adaptation of his novel. He wrote back Wednesday morning:

What a perceptive, well written review. I look forward to reading the play.

Don?t worry about ["Q"]. Take your time. I?m in my own delays as well with this weird deconstructed fiction-memoir or whatever it is.

The most important things are your health and putting coin on the table.

I was glad he told me not to worry because I?ve been doing a lot of that lately. In the last few weeks severe arthritic pain in my hands has prevented me from getting much writing done but it has resulted in a lot of thinking about writing, One thing I had been kicking my ass over a lot lately is why I have not been as productive in the short fiction market as I was between 2004-2010, starting with work for L.A. Stories. And what I?ve come to realize is that, as a writer, short fiction and flash fiction was a growing ?phase? I was going through and I burned through it, having met all of the challenges that I set for myself and, seeing no further challenges to the form, I moved on. Much as I did with my Martin Brimmer phase, and the time I spent penning personal ruminative essays for the likes of Dead Drunk Dublin and Strike the Root.

Last week an organization ? I hate to be vague there but the situation calls for it ? conducted a conference call with many of its members to consider bringing me into their circle of secrecy for an investigative journalism piece; one member warned that the group did not have a good track record with journalists, at which point another chimed in and said, ?I?ve done some research on this guy. He?s not just a journalist. He?s a writer.?

Which is what I am. An all-purpose writer. I go where the money and my interest is. This time last year my interest was in radio plays ? an antiquated form, I know, but also one I know that I can master so I?m going to meet the challenge ? and I will get back to that as soon as I am able to finish the screenplay for ?Q?, not only another personal challenge but a pet project of mine for, literally, decades.

And, in the interim, there?s the journalism project to pursue, the type of project that often falls into my lap unsolicited as a result of being an ?all-purpose writer? and not one who easily fits into a niche. My protagonist from Last Summer at the Marmont, Lewis Grizzard, explains some of the exhaustive wheeling and dealing that goes into the business during a phone call early in the first act:

LEWIS (INTO PHONE)

Jack? Lew Hogue here, buddy. How the hell are ya? ? Yeah? ? Yeah? ? You?re shitting me. I haven?t seen Bobby in a coon?s age. How is he? ? Yeah ? Yeah?? ? ? (laughs)

That?s the old Bobby I know and love. Send my regards next time you talk to him. Listen, I?ve got something here that might be up your alley. I just bought the life story rights of a certain fringe celebrity who?s been?in the limelight a bit recently ? Who? Well, he?s the former gay lover of a big time movie star who shall remain nameless ?

(It?s impossible for LEWIS to stand still now. He is circling the room like a buzzard, cell phone glued to his ear, as he talks.)

LEWIS (INTO PHONE) (CONT?D)

Yeah, that?s him. I didn?t know you read the Enquirer.?(laughs) Listen, this is no joke. The guy has led an interesting life and it would make a great TV movie. He?s more than just a peter puffer to Mr. Boffo Box Office. For one thing, he used to run drugs for Eddie Nash back in the Eighties, turned state?s evidence against Nash, went into the Witness Protection Program and ? Huh? ? What? ? Yeah, I engineered an exclusive to the Enquirer, which netted me five grand, I don?t mind saying, and I managed to get an eight week embargo on the story down to four so I want to strike while the fire?s hot, so to speak. Or is that anvil? ? Huh? ? No, I was just wondering out loud. Is it strike while the fire is hot or while the anvil is hot? Anvil would make more sense, I think.

(LEWIS reacts to a demure knock at the door.)

LEWIS (INTO PHONE) (CONT?D)?When? ? Hold on, let me check my schedule ?

(He retrieves a Day Runner from the bed, paws through the pages)

LEWIS (INTO PHONE) (CONT?D)?Tuesday at one at The Ivy. Yeah, I think I can swing that.

(He closes the Day Runner without making a notation.)

LEWIS (INTO PHONE) (CONT?D) I?ll see you then. And I?ll bring along the contract so you can see it?s all on the level. This could really be something.

(Another knock at the door. A visibly annoyed LEWIS walks to the door while still talking on the cell.

LEWIS (INTO PHONE) (CONT?D) ?No, it was a dollar option?just to keep it all legal, you understand?but this guy can?t sneeze without me owning the snot that comes out of his nose. I?m not gonna make the same mistake I did with Jason Miller. If I?d had the rights to that goddamn play sewn up, Sorvino wouldn?t have beaten me to the punch.

**********

Less than three months after writing that moment I penned the first draft of the play Go Irish: The Purgatory Diaries of Jason Miller, in 2004. I guess you can say that was my ?playwright phase?.

Nora Ephron Remembered By Tom Hanks, Meryl Streep, Nicole Kidman

'At a dinner table and on a film set she lifted us all with wisdom and wit,' Hanks says of late filmmaker.
By Jocelyn Vena

Nora Ephron
Photo:

Nora Ephron's impact on the world of film — particularly romantic comedies, thanks to her memorable scripts for big-screen classics "When Harry Met Sally ..." and "Sleepless in Seattle" — was felt in the wake of the news that the screenwriter, journalist and director passed away on Tuesday at the age of 71 from pneumonia.

Tom Hanks and his wife, Rita Wilson, who both appeared in "Sleepless in Seattle" (Hanks also later appeared in Ephron's "You've Got Mail"), recalled the times they spent with her when the cameras weren't rolling. "Nora Ephron was a journalist/artist who knew what was important to know; how things really worked, what was worthwhile, who was fascinating and why," Hanks and Wilson said in a statement to E! News. "At a dinner table and on a film set she lifted us all with wisdom and wit, mixed with love for us and love for life. Rita and I are so very sad to lose our friend who brought so much joy to all who were lucky enough to know her."

Comedian and 2012 Academy Awards host Billy Crystal recalled the joy of appearing in "When Harry Met Sally ..." in his remembrance of the multi-hyphenate talent. "I am very sad to learn of Nora's passing," he said in a statement. "She was a brilliant writer and humorist. Being her Harry to Meg's Sally will always have a special place in my heart. I was very lucky to get to say her words."

Carrie Fisher, who appeared alongside Crystal in the iconic film, said in a statement to the Boston Globe, "In a world where we're told that you can't have it all, Nora consistently proved that adage wrong. A writer, director, wife, mother, chef, wit — there didn't seem to be anything she couldn't do. And not just do it, but excel at it, revolutionize it, set the bar for every other screenwriter, novelist, director. She was inspiring, intimidating and insightful. She was so, so alive. It makes no sense to me that she isn't anymore. My heart goes out to her family and the many others who treasured her."

The outpouring of love for Ephron hardly ended there. Academy Award-winning actress Meryl Streep, who starred in two Ephron classics, "Heartburn" and 2009's "Julie & Julia," noted that her interests and intellect touched on all subject matters.

"Nora just looked at every situation and cocked her head and thought, 'Hmmmm, how can I make this more fun?' " Streep said. "You could call on her for anything: doctors, restaurants, recipes, speeches or just a few jokes, and we all did it, constantly. She was an expert in all the departments of living well."

Nicole Kidman, who starred in Ephron's quirky big-screen take on the classic 1960s sitcom "Bewitched," noted that it was a "joy to be around" the writer. "She was so smart, warm and funny. I am so grateful that she was my friend and we had the opportunity to work together. My thoughts and love are with her family at this time. I will never forget the dinners, games and laughter we all shared," Kidman said.

Leave your condolences for Nora Ephron's family and friends in the comments below

Android 4.1 SDK hands-on

Android 41 SDK in photo and video

Too lazy to download and install the brand new Android SDK yourself, don't feel like tweaking an AVD for optimal operation? Don't know what an AVD is? We don't blame you, and that's why we're here. We fired up Jelly Bean in the Android emulator and started poking around a bit. Sadly, most of the most exciting new features -- offline speech recognition, Google Now -- don't work. And we couldn't really delve deep into the new notifications system thanks to some limitations on the SDK. We could, however, play with the new version of Maps and demo the new widget placement tweaks. Most of the UI should look familiar. In fact, the only obvious changes we noticed were the new search widget and a few tweaked buttons, like notification clearing option. You'll also notice a new layout for the clock and date in the notification pull down. Mostly, from a aesthetic point of view, the refinements are minor, but welcome. Everything feels a little more spacious, less cramped, without becoming overly simple. Want to see it for yourself? Check out the gallery below and the video after the break.

Do You Have the Franchisee Attitude? | Franchwire

This is the second part of our guest post ?Startup or Franchise: The Choice is Yours!? from Paul Segreto President & CEO at franchisEssentials, and Founder at franchisEssentials Media Group.? Click here to see the first part of the post.

The key questions posed by many emerging small business owners are asked very emphatically, ?Can I achieve my goals and objectives as part of a franchise system? And, do I have what it takes to be a successful franchisee??

In addressing these questions (and concerns), it?s relatively easy to analyze the two and realize, beyond the viability of a particular franchise brand as addressed in due diligence of the franchise concept itself, the answers are really contingent and dependent upon each other. The answers actually lie in understanding the mindset required to be a franchisee. Once understood, a choice must be made regarding the desired path either as an independent small business owner or as one of the hundreds of thousands of franchisees across several thousand franchise concepts worldwide.

The typical franchisee must be willing to follow and adhere to a franchise company?s business system and ultimately, promote the same within their new franchise community at all times. It must be completely understood the system cannot be changed by the franchisee nor can their business be operated differently than the franchise company requires as the system is proven and uniform across the chain. It?s this uniformity throughout the organization that is paramount to brand awareness leading to company and franchisee success and is the foundation of an interdependent relationship between both parties to the franchise agreement.

A franchise is almost definitely not the right choice for the business maverick or renegade. Certainly, there is an important place in business and in our hearts for these unique innovators. If not, we wouldn?t know Apple or Dell Computers as they?re known today. Even McDonalds, as probably the greatest franchise of all time that stormed through the country under the leadership and direction of a true maverick, Ray Kroc, would not have been successful without franchisees being required to strictly follow and adhere to the McDonalds system without fail. No questions asked and no room for negotiation.

Entrepreneurs will be around for centuries to come blazing trails as never before. Some will actually plan to choose franchising as an expansion strategy and build the foundation of future franchise concepts. They will provide a choice for tomorrow?s small business owners on whether to go it alone or invest in a franchise. And, it will be those franchisees of tomorrow that will follow, promote and expand those systems that will prove to be the steel, bricks and glass built upon the foundation of new franchise companies. Thus, continuing the growth of franchising as it expands throughout the world; truly a way of giving back by affording people more opportunities and options in determining the path to small business ownership that suits them best.

Buyers
Your Home Inspection will provide you with valuable information about the home you are going to purchase. Some of the issues found in a home inspection may be repaired by the seller, or the purchase price could be adjusted to allow for repairs. This means less money out of your pocket and more peace of mind for you.

Sellers
Do you think you know your home? Don?t let a buyer?s inspection catch you by surprise! Get your home inspected before listing it. Make the necessary improvements and we can re-inspect it. The new inspection report will show a clean bill of health. Your Realtor can use this report to market your home as MOVE IN CERTIFIED and make it stand out from all the bank owned properties. Get your asking price with no haggling.

Investors
Use the initial home inspection to assess your purchase and help you with your cost analysis. When you are ready to resell, the report may be updated to show the current status of the home and can be used as a selling tool. If you are going to rent, the inspection report is documentation of the homes current condition when the lease is signed. This will protect you when tenants leave.

New Homeowners
Your homebuilder gives you a warranty on your new home. Don?t let that opportunity slip by. Many defects are not obvious to the untrained eye. Let a professional prepare your punch list for the builder. The inspection report will also advise you on maintenance items. This will help you preserve the value of your home.

Construction Phase Inspections
If you are having a home built, there are key times during the process when you want to get an inspection before possible defects are covered up. This inspection can be tailored to your individual needs.

Matrix One is a $99 Android ICS tablet that could ship to retailers next month but probably won't handson video

From Barcelona to Hanover to Vegas and Taipei, we've seen our fair share of low-end Android tablets, some of which actually offer a bit of promise, and get it done for under 200 bucks. And while even a few sub-$100 models have littered the exhibition hall floors, they're most often mere vaporware, never actually making their way to US and European retailers and online shops. The Matrix One, for its part, could actually get the nod of approval from big box execs, however -- according to company reps, at least. And it wouldn't be a half-bad option at $99, shipping with Android 4.0.3, a 2-megapixel webcam, 1.5GHz Cortex A8 processor and an 800 x 480-pixel 7-inch capacitive display. Those specs also make their way to a nearly identical $149 flavor, which ups its budget counterpart's 512MB RAM and 4 gigs of storage to 1GB and 16GB, respectively, while keeping the other components intact.

While that display won't best any brand-name slab on the market, it's certainly usable, even in bright sunlight, as we experienced today at CE Week in New York City. The tablet performed just fine during our quick demo, which included navigating through some menus and watching a few HD video clips. The built-in speaker on the rear won't come close to filling a room (or even a noisy car, perhaps), but a headphone jack will let movie fans and youngsters alike appreciate content a bit more, especially if traditional tablets are priced out of reach. There's also an HDMI port for outputting 1080p video to a TV, along with one full-size USB port, a mini-USB connector for syncing and updates, a power port and a micro-SD card slot, for adding up to 32 gigs of extra storage.

You'll also find a built-in mic and a two-megapixel webcam (no rear-facing shooter, however). All in all, the 11.1-ounce package is quite polished, especially given the price. We won't likely be adding the Matrix One to our personal collection, but if a $99 tablet is on your must-have list, this wouldn't be a bad choice -- let's just hope it does indeed pop up in stores, perhaps as soon as the tablet's ready to ship at the end of next month. There's a gallery below if you'd care to take a closer look, and do jump past the break as well -- that's where you'll find our hands-on video, with a lively Manhattan soundscape to boot.

2013 Mercedes-Benz GLK350 4MATIC Test Drive

On Sale Date: August 2012

Price: $36,000 (est.)

Competitors: Audi Q5, BMW X3, Cadillac SRX

Powertrains: 3.5-liter V-6, 302 hp, 273 lb-ft of torque (4MATIC); 2.1-liter I-4 turbo-diesel, 190 hp, 369 lb-ft of torque (BlueTEC 4MATIC)

EPA Fuel Economy (city/hwy): TBD

What's New: Although the GLK's midcycle refresh incorporates only mild styling tweaks, with updated bumpers, headlamps, and interior trim, the mechanical alterations introduce nearly 1000 new parts to the boxy sport ute. Key among the changes are two new powerplants: A direct-injected 3.5-liter V-6 with a gain of 35 hp over its predecessor, and an upcoming 2.1-liter four-cylinder turbo-diesel BlueTEC model. Both promise upgraded fuel economy, Mercedes says, aided by the addition of stop/start technology and a new electromechanical steering setup, though we don't have the official numbers just yet. Mercedes-Benz's Attention Assist feature meant to combat drowsy driving is now standard, while new options include a variety of more in-depth driver assistance items as well as an AMG exterior styling package.

Tech Tidbit: Automakers usually cite better mpg as the reason to include electromechanical steering, but the GLK350 adds another reason for a nonhydraulic setup: Active Park Assist. Thanks to the new electrically driven arrangement, the GLK can parallel park itself, as long as it detects a space that's 39.4 inches longer than the car. Just confirm the auto-park feature and pop the gearbox into reverse; as long as speed remains below 7 mph, the steering will maneuver the vehicle into a spot.

Driving Character: We'll always prefer the driving dynamics of compact SUVs to those of bigger, bulkier sport utility vehicles, and the GLK350 is no exception. Thanks to a relatively short wheelbase and wide track, this baby SUV feels closer to a C-Class sedan on the road than it does to its cargo hauling stablemates.

Acceleration is noticeably brisker thanks to the brawnier V-6, and the stop/start feature stops and starts smoothly enough at a standstill. The updated interior comes across as more accommodating than that of its harder-edged predecessor, and the front buckets shine with typical Mercedes-Benz comfort. The back seats, on the other hand, are a bit cramped.

Favorite Detail: Thanks to heightened competition in the compact luxury SUV segment, Mercedes-Benz has stepped up its game with an interior that feels fancier than its price point might suggest. Our favorite feature? The no-cost optional wood trim, which gussies up the cabin.

Driver's Grievance: As much as automakers have promised us better electromechanical steering (and we've seen some systems that work as advertised), the GLK's arrangement lacks the feedback and feel of a traditional hydraulic setup. It exhibits a slight but noticeable buzz during slight on-center corrections.

The Bottom Line: Mercedes-Benz's GLK-class has proven a likable little sport utility vehicle, as evidenced by its increase in sales over recent years. Although its steering response takes a step down, the GLK's increased power, enhanced efficiency, and sexier styling makes it worth serious consideration in this hotly contested segment.

Pre-summit document presses EU banking union

BRUSSELS (Reuters) - European leaders will discuss specific steps towards a cross-border banking union, closer fiscal integration and the possibility of a debt redemption fund at a summit on June 28-29, according to a document prepared for the meeting.

Two officials familiar with the 10-15 page document, drawn up over the past month and which is still being revised ahead of the summit, said it sets out in detail the four "pillars" required for a strong economic and monetary union which leaders believe is necessary to secure the currency project's future.

As well as progress towards a banking union, the paper discusses the need for a more integrated budget policy, steps required for deeper economic integration, and how to retain "democratic legitimacy" if countries give up some sovereignty.

The document has been drafted by European Commission President Jose Manuel Barroso, European Council President Herman Van Rompuy, European Central Bank chief Mario Draghi, and Jean-Claude Juncker, head of the Eurogroup countries using the euro.

European leaders have already said the first area they need to work on is a banking integration as they try to break the link between bad banks and indebted governments, with the worsening situation in Spain an immediate concern.

EU officials believe that could be achieved in a year, although Berlin wants to see much more progress towards fiscal integration first, something that would require much longer due to the need to change the European Union treaty to achieve it.

The document goes into most detail on the banking proposals, setting out the need for a single European banking supervisor, a common EU deposit-guarantee scheme and a single bank-resolution fund to wind down the region's bad banks, the officials said.

The paper sets out options under each heading, saying that when it comes to a single banking supervisor it could either be charged with overseeing all EU banks, or else look after the major systemic banks with cross-border operations, while another body looks after broader, day-to-day oversight.

The expectation is the ECB will eventually be given sole responsibility for overseeing Europe's biggest banks, while the European Banking Authority watchdog retains a broader oversight role along with coordinating the work of national regulators.

On a common deposit insurance mechanism, the paper suggests that there needs to be a strengthening of and closer integration among national guarantee schemes to provide a more reassuring backstop across the whole European Union.

On a resolution fund to deal with failing banks, it calls for a single mechanism "with a large envelope" that would be financed via levies on the banking sector, such as a financial transaction tax, and would offer "an integrated EU solution for resolution".

The document, which draws heavily on proposals made by the European Commission on June 6, says an "immediate and permanent mutualisation" of risk may be required to backstop the banking sector. It suggests the euro zone's permanent ESM bailout fund could be used to recapitalize banks directly, rather than having to lend to governments for on-lending to banks.

All of those proposals would be possible under existing EU treaties and could be implemented relatively rapidly, the document indicates.

Even if it took only a year, this will probably not come quick enough to ease market pressure on Spain and Italy that is now reaching danger levels, although some analysts believe a strong signal of intent could help. That could also persuade the ECB to step in.

"Short term, there is clearly a risk that the summit will disappoint markets yet again. If that were to be the case, I have no doubt that the ECB will step in," said Erik Neilsen, global chief economist at Unicredit.

That could take the form of an interest rate cut, further easing of collateral rules for Spanish banks so they can continue to access ECB funds or even a resumption of the bank's bond-buying program, which several of its policymakers oppose, he said.

BUDGET INTEGRATION

In a second section examining the steps required for closer fiscal coordination, the document says there is a need to go beyond existing legislative proposals such as the fiscal treaty, which 25 of the EU's 27 countries have signed up to and which commits them to a balanced budget.

The paper says that as closer banking and fiscal integration is achieved, the issue of mutualisation of debt will become more immediate and it raises the option of a debt redemption fund along the lines of that proposed by Germany's "wise men".

That is an idea that France, Italy and others have pushed hard for but which German Chancellor Angela Merkel opposes.

Merkel has not ruled out a sharing of debt per se, but has said any discussion on it can only happen at the end of a long process of integration that is likely to take many years. In contrast, France will find it difficult to stomach the loss of sovereignty that fiscal union would demand.

"The political leaders are now trying to move to a degree of fiscal and political union within a very short period of time. In democracies, such changes usually take a few years, and whether enough can be achieved in time remains to be seen," Neilsen said.

"However, in my mind, this does not imply an imminent risk of a breakdown of the euro zone ... It's a political project, and political leaders are unlikely to throw in the towel because markets don't like the policies."

Other sections of the document discuss the broader aims of greater EU labor mobility, efforts to improve pan-EU competitiveness, and to examine common taxation such as a common corporate tax base and a financial transactions levy.

There is likely to be heated discussion on issues such as debt mutualisation and any pooling of liability under a banking union, with Germany adamant that it will not be put on the line to underwrite the liabilities of other euro zone countries.

No decisions are expected at the summit, but if leaders agree that there are grounds to push ahead, Barroso, Van Rompuy and the others will be given a further mandate to develop the ideas in greater detail, including more specific timelines.

Van Rompuy has said he hopes to have a more thorough set of plans drawn up by the next EU leaders' summit in October or possibly the one after in December.

Building The Compose, Layout, Furniture and Themes Restaurant Business

Building The Compose, Layout, Furniture and Themes Restaurant Business

When it comes to starting a restaurant, beget, layout and theme can be crucial to its success. You want a comfortable, welcoming atmosphere but you also have to judge practically. unprejudiced because you are in treasure with a definite type of window treatment that doesn?t mean that it?s durable enough to be obsolete in a busy eating establishment.

Your basic belief is what you will gain upon. Do you want an atmosphere more akin to a family dining room or do you want a more upscale ambianceall The age of your target audience is also an principal consideration. While a family restaurant will have to be durable and sturdy, a hangout for a young adult crowd has different demands as does a buffet-style layout.

Be positive that your idea and gain has longevity. If you bewitch into the make of a novel fad you will net yourself redesigning your restaurant, sometimes within months. You may want to project the atmosphere of an exotic culture like the Tiki bars of the 40?s and 50?s or faithfully reproduce a Far Eastern Tea House. Whichever kind of get you decide, be certain that it is classic and enduring unless, of course, you bask in frequent redecorating and interrupted traffic.

Lighting is one of the most famous aspects of make and can effect or crash a restaurant. Too harsh and customers wont return, too unlit and you may have the same reaction. If you want to develop a warm and romantic atmosphere, intimacy is more famous than dimness. While customers may not realize it, lighting is one necessary factor in creating an overall dining experience that is clear and leaves customers wanting to return.

Traffic patterns are well-known too. earn it easy for your waiting staff to skim their tables without colliding and provide paths wide enough to accommodate serving trays without intruding on other tables. A central region for dropping off and retrieving orders will sustain traffic titillating smoothly. design obvious that the public restrooms are easy to net and discreet as it can build everyone?s time if customers don?t have to ask for directions.

Furniture and fixtures should be not only aesthetically elegant but also durable and strong. You should also mediate how easily your staff can go the furniture to well-kept around and underneath it. There are a variety of glorious materials and textures for tables, chairs and benches that are durable and inspect broad for many years.

The comfort of your diners is a consideration, too. There are very few successful restaurants with hard wooden chairs and those that do have them are usually the kinds of expeditiously service restaurants that want customers to accomplish their meal and travel on in a race.

Consistency is imperative for a successful restaurant. From the manufacture of the plates and flatware to the presentation of the food, your clientele wants to know what to quiz each and every time they visit. The manner of your waiting staff is also crucial. Customers should be confident that they will always procure a server that is polite, profitable and efficient.

If your restaurant has market appeal and becomes the first choice of those who have the opportunity to go out for dinner, it will be hard not to succeed. A restaurant that looks captivating on the outside, is comfortable and welcoming on the inside and that has a waiting staff that enjoys the job will always have a valid clientele.

Phoenix Suns News And Notes: Five Days Before NBA Draft - Marshall Or Moultrie?

He can jump, anyway.

Last year about this time, we started hearing more and more about two prospects in relation to the Suns that hadn't previously been linked to the Suns at all (Markieff Morris and Iman Shumpert). We were all "Who?" But in retrospect, the Suns had fallen in love with both players and both turned out to be solid values at #13 despite little buzz around them.

This year, the loved ones appear to be PG Kendall Marshall and PF/C Arnette Moultrie. Both are talented enough to be picked at #13, but neither has been linked to the Suns until recently. Marshall has a pass-first game and mentality similar to the Suns' incumbent PG while being compared to Andre Miller and Jose Calderon, while Moultrie's game has been compared to Kris Humphries and Jason Thompson. (Interesting that 3 of those 4 are free agents this summer.)

Will the Suns eschew their shot-creating shooting guard need in favor of a new PG or PF/C? What if Jeremy Lamb is still on the board, or Terrence Ross? If Marshall is drafted, is that a goodbye signal from Nash? If Moultrie is drafted, is that a goodbye signal to Channing Frye or Robin Lopez?

Star-divide

I sure hope Paul Coro of azcentral.com doesn't hate me for using his tweets for story ideas so often, but Paul is the only guy reporting new information about the Suns these days and I just don't have the connections like he does. We love you, Paul! And I will ALWAYS give you full credit for breaking news.

Marshall-moultrie_medium

Since we'd previously reported that Marshall had posted a local channel's pic of Phoenix weather on Wednesday night, can we guess that Marshall was in Phoenix for at least two more days this week? Sounds like a budding love affair to me.

And who's this Arnette Moultrie character? BSotS hasn't even done a prospect preview on him, which probably guarantees he will be the ultimate pick. I'd better get working on that sucker. Draftexpress.com compares Moultrie favorably to Kris Humphries and Jason Thompson, meaning he's got length and rebounding ability and little in the way of offensive skills.

However, Moultrie has shown some shooting ability and fancies himself a PF rather than a C. In fact, he is so sure he's a PF that he declined to work out at the Chicago pre-draft combine when he learned he was slotted with the centers. Impetulant? Maybe.

So, with Moultrie and Marshall coming back in for their second visits in a week, what does that say about the shooting guards that have been linked to the Suns since the end of the season? Not one of the top 5 SGs (Beal, Waiters, Rivers, Lamb, Ross) have even stepped off a plane into the 100+ degree heat yet and it's only 5 days till the draft!

In fact, Waiters is now firmly ensconced in the top 11, being linked to every team from 6-11. Rivers also believes he's top 10 material, refusing to work out with any team who's top pick is outside #10.

Hmph. BSotS certainly spent a lot of writer's cramping on SGs prospects the last few weeks. And for nothing?

Well, at least Lamb is coming to Phoenix for a visit. He rolled his ankle a week ago and hasn't worked out for anyone since. According to our beloved Suns reporter, he's here today.

Lamb-coming-in_medium

Lamb can play some solid defense (what the Suns want, bigtime) but has no leadership qualities of his own, and rarely creates his own offense from scratch (kinda like the rest of the Suns already on the roster).

The same can be said of Terrence Ross, who is clearly projected to be picked at or below the Suns #13, yet has not even touched down in Phoenix yet. Either the Suns have no interest in Ross, or they were waiting for pair him with Lamb. Is Ross here with Lamb today? Will he come to town in the next 3-4 days? Who knows.

What we do know is this: the Suns are considering a PG and a PF/C if they don't like what they see from Lamb and Ross in the next few days.

Youkilis in tough spot? |? Trade coming soon?

???
BOSTON ? It?s not an easy situation for Kevin Youkilis. The veteran player, who has been with the Red Sox since being drafted in the eighth round of the 2001 draft, very likely has very little time left with the Sox as trade rumors continue to heat up.
?
And with Will Middlebrooks playing like the highly prized prospect the Sox thought he was, Youkilis? playing time will become increasingly limited, if as manager bobby Valentine said, he wants to play the hot hand.
?
?I have no thoughts on anything,? Youkilis said. ?I haven?t been told anything so until I?m told anything I can't really respond.

?You want to play. I definitely want to play. You want to play the game, you want to enjoy it and you want to have fun. I don?t know my situation. I never was told what?s going on here. Let?s put that straight. And I?ll leave it at that. I don?t want to start up anything. There was no conversation. That was it. But it has been addressed.
?
?It?s been addressed I?m not playing today, but other than that?basically there was no conversation about it. I?m just coming in and getting my work done and if I need to pinch hit and play the game, I?ll come in and play.?
?
Asked how it was addressed, Youkilis replied:
?
?I?ll leave it at what was said.?
?
With the July 31 trade deadline a little more than five weeks away, Youkilis will continue to hear his name attached to trade rumors.
?
?It?s definitely different and you?ve got to go day to day,? he said. ?it?s definitely unknown waters but all you can do is come to the field, do your work and try to improve with going in the cage or going out on the field and working on ground balls, So that?s what I?m doing, is taking ground balls, hitting in the cages, doing some extra work today and trying to do whatever I can to keep fresh.
?
?Trying to do whatever I can to keep fresh.?
?
Youkilis made his big league debut in 2004, the year the Sox won their first World Series title in 86 years, and was a central figure in the 2007 title. He has been a three-time All-Star with the Sox. But the last few seasons, he?s been limited by various injuries.
?
?Definitely hit all the ups and downs,? he said. ?I probably could describe it to you 10 years down the road better. When you're in it you really can?t describe the stuff you're in. Somebody?s going to have to remind me about a lot of the times here. I?ll ask Pedey. Pedey remembers everything. You see it all and to be continued, I guess.?
?
He said he?s trying not to focus on the ?what ifs?.
?
?No. I just go out and?I?m just trying to work on things,? he said. ?I?m trying to hit, stay fresh, get my work in. That?s my whole mindset every day I come to the field, just get my mind set and ready to play.
?
?I have no control of that. I can only control the stuff I can control and I?m just going to go out there every day and take batting practice and cheer on the guys when they play.?
?
He missed 22 games earlier this season with a low back strain, and is hitting just .225. He can?t improve his offense if he?s not in the lineup, he said.
?
?I don?t know. I went 2-for-3 my last time but if you don?t play I don?t know how much closer you can get,? he said. ?If you don?t hit and you don?t play, you can't put up any stats or hits. I raked in the cage, if you want to know that. I was hitting missiles all over the place, but you don?t get credit for that.?
?
?I was hitting the ball good. In the game in Chicago too I hit the ball good and had nothing to show for it. I?m definitely going in the right move but I?ve got to keep working at it and keep grinding away, in the cage and taking ground balls and just try to stay fresh in case my name gets called at any time.
?
Asked about his time with the Sox and winning a World Series, Youkilis replied:
?
?Is this a goodbye thing? What?s going on here? I?m just sitting in my locker. I haven?t been told anything. Let?s talk about today. I?m still here. I?m not dead.?
?
Middlebrooks has started the last three games, while Youkilis has watched from the bench.
?
?I don?t know. I?m a paid employee here so they make the decisions,? Youkilis said. ?When you're a paid employee and your boss tells you to do something you do it. Until they tell me something I?m here to play for the Red Sox.?
?
Middlebrooks credited Youkilis with helping him make the transition to the big leagues.
?
?Will and Ryan [Kalish] and the young guys it's fun to help them out because sometimes they need it,? Youkilis said. ?it?s fresh to them and they're going to make mistakes, like the veterans make mistakes, too, on the field and they look up to the veterans sometimes. And some of the mistakes that we made early on in our career we had a veteran come up to us and tell us what to do. When you play this game you're an ambassador to the game as a player so you have to be that way and you can't be selfish if you're not playing. You?ve got to teach these guys how to play this game because someday we?re all going to retire and these guys are going to be playing, and there?s going to be guys after them, so if they can pass along the messages to the guys after them, the guys that are playing to them when they?re young too down the road, that?s the key. I was taught that in 2004 by some great players here and I?m just trying to pass on the knowledge that was given to me.

?God, there were so many of them. That 2004 team, I mean I hung out with Mark Bellhorn a lot but Trot Nixon was always great. Mainly the guys that were there to talk a lot?Dave McCarty was really big and helped me out and [Doug] Mirabelli was always good at making fun of me and joking around, and [Tim] Wakefield and [Jason] Varitek. There?s a list. Bill Mueller was great, too. I can't say one [person] but there?s such a good core ground and that helped, and that?s how it?s got to be. That happens on all the teams.?
?
But taking his replacement under his wing cant? be the easiest situation for Youkilis.
?
?Can?t change who you are and what you do and I?ve always tried to help them out,? he said.? ?I?m not going to change who I am and what I do. I?m just going to try to help them out every day.?
