Leaked: First Look at the Upcoming Apple iPad 5

ipad

We will naturally have to take this leak with a grain of salt, but it looks like we are getting our first look at the upcoming fifth-generation iPad from Apple. There aren?t too many surprises here, as it has been rumored for months that the next iPad would borrow much of its design inspiration from the smaller iPad mini.

This is just a look at the back plate and the leak comes by way of a China-based iPad accessories maker. The back looks like it will have the same black and slate appearance as its smaller cousin, along with thinner casing and chamfered edges. We?re also hearing that the overall footprint will be smaller, because Apple will be shrinking the bezel around the 9.7-inch display. You?ll also notice the top portion of the back plate, which seems to indicate that this would be the LTE model.

ipad

When can we expect to see the iPad 5 announced and hitting the market? There are two conflicting rumors at this point. On the one hand, some people are saying that the fifth-gen iPad could launch as early as March. On the other hand, with the 128GB version of the iPad 4 just launching now, it is possible that the iPad 5 isn?t quite ready. Given that, we?re hearing an October launch window is more likely.

Obama's gun plan begins slow, scrutinized trek through Congress

By Michael O'Brien, Political Reporter, NBC News

The Obama administration?s gun violence proposals are beginning their arduous path through Congress, as the opening act moves to the Senate Wednesday and?lawmakers begin to pick apart some of the plan?s most ambitious gun control measures.

Majority Leader Harry Reid, D-Nev., on?Tuesday vowed?to bring up some version of President Barack Obama?s comprehensive gun violence proposal for a vote on the Senate floor when it is ready. But he said Republicans would also be free to offer amendments to the bill, which could lengthen the legislative process and strip stricter gun control measures of their teeth.

?It's very clear that there's going to be a bill brought out of the committee, brought to the Senate floor, and there will be an amendment process there, the people bringing up whatever amendments they want that deals with this issue,? Reid told reporters Tuesday on Capitol Hill.

Alex Wong / Getty Images

Senate Majority Leader Sen. Harry Reid speaks to members of the press after the weekly Senate Democratic Policy Luncheon at the U.S. Capitol January 29, 2013.

The Nevada Democrat?s comments come as Congress begins the challenging process toward approving its first major piece of gun legislation since the 1990s.

The Senate Judiciary Committee holds its first hearings that topic on Wednesday, featuring high-profile witnesses on either side of that issue. Speaking in favor of gun control will be retired astronaut Mark Kelly, the husband of Gabrielle Giffords, the former Arizona congresswoman injured critically in a 2011 shooting.

On the other side will be National Rifle?Association CEO?Wayne LaPierre, whose influential gun rights lobby is working to thwart the administration?s proposals on Capitol Hill. According to LaPierre?s prepared testimony, released Tuesday by the NRA, he will stake out a clear stance against the heart of the president's plan.

?When it comes to the issue of background checks, let?s be honest ? background checks will never be ?universal? ? because criminals will never submit to them,? said LaPierre in those prepared remarks.

LaPierre's testimony on Wednesday will surely reflect the sharp opposition to the Obama plan among gun rights groups; aversion that threatens to transform the battle into a legislative slog and sap the administration?s momentum.

Skepticism over assault weapons ban
While the outrage prompted by the December rampage at Sandy Hook elementary school has lingered longer than previous mass shootings, the impetus for gun control measures threatens to fade as time passes.

Already, one of the central proposals from Obama?s plan ? renewing the ban on assault weapons ? faces an uphill battle to be included in any final legislation.?

The New Republic's Chris Hughes and Frank Foer join Morning Joe to discuss the publication's relaunch which features a wide-ranging interview with President Barack Obama.

Reid, who has said he would not seek Senate passage of legislation that had no chance of approval in the House, was non-committal on the issue of the assault weapons ban during his comments on Tuesday.?

?I'll take a look at that,? he said of a proposed ban on assault weapons favored by California Democratic Sen. Dianne Feinstein.

?As I've indicated to you folks, we're going to have votes on all kinds of issues dealing with guns. And I think everyone will be well advised to read the legislation before they determine how they're going to vote for it.?

Speaker John Boehner, R-Ohio, has said that the House would consider whatever legislation on guns the Senate manages to pass, but has committed to little more than that.?

And, in fact, whatever legislation the Republican-controlled House is able to consider might depend ultimately on a handful of moderate Senate Democrats.

Several of those lawmakers have expressed skepticism toward the assault weapons ban, but have conveyed more interest in universal background checks ? the element of Obama?s plan that gun control proponents that might have a better chance at passage.?

That provision appears poised even to win some Republican support: Oklahoma Republican Sen. Tom Coburn told a Tulsa television station on Friday that he?s working with Democrats on legislation to ensure universal background checks.?

Senate Minority Leader Mitch McConnell, R-Ky., was more reluctant to endorse such a measure, saying during an availability at the Capitol on Tuesday: ?I'm among those who'd be happy to take a look at whatever the majority decides to advance on that subject.??

But Paul Ryan, the Wisconsin congressman who frequently mentioned his pride as a hunter during his time as Mitt Romney?s running mate appeared to lend support to that idea during a Sunday interview on ?Meet the Press.??

?I think the question of whether or not a criminal is getting a gun is a question we need to look at. That's what the background check issue's all about,? he said. ?And I think we need to look into making sure that there aren't big loopholes where a person can illegally purchase a firearm.?

Satellite Spies Severe Weather Brewing

After an Arctic blast left much of the United States out in the cold, a new system is bringing the threat of severe weather to the central portions of the country this evening and through the night. A satellite snapped an image of the system earlier this morning (Jan. 29).

The National Weather Service's (NWS) Storm Prediction Center, located in Norman, Okla., has forecast severe thunderstorms, with damaging winds and hail ? and possibly even tornadoes ? for the lower Ohio Valley, the mid-South and the lower Mississippi Valley. The SPC says the threat will increase through the night, with squall lines (or long lines of thunderstorms) and individual storms rolling through along with a cold front.

Nighttime storms and tornadoes can be particularly deadly, as people tend to be in bed and unaware of warnings and the storms are harder to see as they bear down. A 2008 study in the American Meteorological Society's journal Weather and Forecasting found that nighttime tornadoes were 2.5 times as likely to cause a death as those that occurred in the daytime. The threat of deadly nighttime tornadoes is exacerbated in the winter with the season's shorter daylight hours. [5 Deadliest Tornado Years in U.S. History]

Tennessee leads the nation in the proportion of nighttime tornadoes it sees, with nearly half of the twisters in its borders striking after dark. Western Tennessee is one of the places that could see severe weather in this latest bout, along with most of Arkansas, and parts of Louisiana, Kentucky, Missouri, Mississippi, Illinois, Indiana and Oklahoma.

The National Weather Service has issued several tornado watches and severe storm warnings and alerted residents to the possibility of large hail and high winds, as well as lightning strikes. The Weather Channel reported on its Twitter account that as of 2 p.m. ET, 24 severe weather reports, 10 severe wind reports, 14 hail reports and no tornado reports had been made. It also reported unconfirmed reports of a funnel cloud to the west of Jefferson City, Mo.

The GOES East satellite (run by NASA and the National Oceanic and Atmospheric Administration, the parent organization of the NWS), snapped an image of the cold front and accompanying stormy conditions at 10:15 a.m. ET.

The cold front will sweep eastward on Wednesday and could bring severe weather to parts of the East Coast, from the Gulf Coast northward. By Wednesday evening, it could impact Washington, D.C., and New York City.

Urine the Army Now

Sergent Sheena Adams Jerry Boykin thinks that combat missions with women are too humiliating for men

Photograph by Paula Bronstein/Getty Images

Should women be allowed in combat? The Pentagon says yes, but Jerry Boykin knows better. Boykin, a former Army lieutenant general, is the executive vice president of the Family Research Council. Since last week, when the military announced its decision to rescind the combat ban, Boykin has become the point man for opponents of the decision. It isn?t easy in 2013 to make the case that every man should be eligible for the draft but that no woman should be permitted to compete for a combat role in much of the armed forces. Is Boykin man enough for the job? Let?s see how he?s doing.

1. Women are too weak. ?We have seen in Iraq and Afghanistan that ground combat still requires levels of sheer physical strength, speed, and endurance that are relatively rare among women,? Boykin wrote in a USA Today op-ed on Thursday. A day later, in a commentary on CNN, he added,

The slots that may be opened are in our infantry and Special Forces units. The purpose of such units is to directly and physically engage enemy forces. This can often involve personal, hand-to-hand combat in which women will now have to fight men. These units can often be deployed in prolonged operations that can last for months. The physical toll is constant and wearing.

When Boykin talks about hand-to-hand combat and women fighting men, he seems to be suggesting that women can?t or won?t fight men effectively. But if combat-level physical abilities are ?relatively rare? among women, rather than nonexistent, doesn?t that undermine the idea of a categorical ban on women in combat? So Boykin turns to other arguments.

2. Combat missions are too gross for women. Boykin objects that infantry and Special Forces units are sometimes sent on months-long missions:

During operations of this kind there is typically no access to a base of operations or facilities. Consequently, living conditions can be abysmal and base. There is routinely no privacy or ability to maintain personal hygiene for extended periods. Soldiers and Marines have to relieve themselves within sight of others.

So the problem isn?t that women are inherently too weak to carry the gear or kill a man in a knife fight. The problem is that they might have to skip showers or pee in the wild.

3. Combat missions with women are too humiliating for men. On Fox News Sunday, Chris Wallace pointed out that Col. Martha McSally, the country?s first female combat pilot, defeated her male competitors in the military division of the Hawaii Ironman World Triathlon Championships. ?Clearly, some women can meet the standard? for combat, Wallace suggested. Boykin replied:

Some women can, and there will be few, but some can. But that's not the issue I raised initially. What I have raised is the issue of mixing the genders in those combat units where there is no privacy, where they are out on extended operations, and there's no opportunity for people to have any privacy whatsoever. Now, as a man who has been there, and a man who has some experience in these kinds of units, I certainly don't want to be in that environment with a female, because it's degrading and humiliating enough to do your personal hygiene and other normal functions among your teammates.

Ah. So the problem isn?t that women might have to pee near men. The problem is that men might have to pee near women.

4. Women are too sexy. In his essay for CNN, Boykin argued,

This combat environment?now containing males and females?will place a tremendous burden on combat commanders. Not only will they have to maintain their focus on defeating the enemy in battle, they will have to do so in an environment that combines life-threatening danger with underlying sexual tensions. This is a lot to ask of the young leaders, both men and women, who will have to juggle the need to join and separate the sexes within the context of quickly developing and deadly situations. ? Men and women can serve together in the armed forces productively, but that service needs to be prudently structured in a manner that reflects the differences between the sexes and the power of their attractions.

CORAL IN CRISIS

Slowing growth threatens the survival of many Caribbean coral reefs (shown).

Reefs in the Caribbean are experiencing a budget crisis: Corals? production of calcium carbonate ? their bony material that creates reefs ? is way down, a 16-month-long investigation finds. Shallow-water reefs are in especially bad shape, with growth rates that are 30 to 40 percent of historical values. Many of these shallow sites also lack Acropora species, which are key reef-building corals that typically produce a lot of carbonate. These degraded reefs also have a lot of smothering seaweed and few critters to graze upon it, the study of 19 sites found.

The new analysis, published January 29 in Nature Communications, suggests that when the amount of live coral in a reef drops below about 10 percent, erosion begins to outpace growth of new reef structures. Many Caribbean coral reefs are approaching this tipping point, the team led by Chris Perry of the University of Exeter in England found. Ongoing assaults such as warming waters and ocean acidification may further hinder reefs? efforts to get their budgets back in the black.

Secret Service dog falls to death at Biden event

(AP) ? The Secret Service says one of its canines fell to its death at a New Orleans fundraiser where Vice President Joe Biden was speaking.

Secret Service spokesman Ed Donovan says the dog was doing a security sweep Saturday of a parking garage next to the Ritz-Carlton. That's where Biden was attending a fundraiser for Louisiana Sen. Mary Landrieu's re-election campaign.

The Secret Service said the death was a tragic accident. Law enforcement officials aren't releasing the name or gender of the dog.

The Secret Service in the past has exclusively used Belgian Malinois dogs, which are known for being good workers and for adapting well to new environments. The specially trained canines can be used to detect explosives and firearms.

16 sick in 5 states; linked to ground beef recall

(AP) ? Federal health officials say at least 16 people in five states have been sickened by salmonella food poisoning linked to ground beef.

No one has died, but half were hospitalized. Most of the illnesses have been in Michigan, but a few cases were scattered in Arizona, Illinois, Iowa and Wisconsin.

Seven people ate a raw ground beef dish called kibbeh (kib-BEH') last month at a suburban Detroit restaurant that wasn't identified. Health officials say consumers should not eat uncooked meat.

The Centers for Disease Control and Prevention said the cases have been linked to last week's recall of more than 1,000 pounds of ground beef from two Michigan businesses, Troy-based Gab Halal Foods and Sterling Heights-based Jouni Meats.

France favors Lauvergeon as EADS board chief: paper

PARIS (Reuters) - French President Francois Hollande wants Anne Lauvergeon, former chief executive of French nuclear reactor maker Areva, to chair the board of European planemaker EADS , French Sunday paper Le Journal du Dimanche reported.

The paper quotes a source close to the government as saying that Lauvergeon is "the choice of Francois Hollande for the presidency of the group". It added that Hollande had discussed the nomination with German chancellor Angela Merkel on Monday and that "Germany agrees with the French choice".

The paper added that three other names were on a government short-list: former ECB governor Jean-Claude Trichet, former Saint Gobain CEO Jean-Louis Beffa and former Air France CEO Bernard Attali.

Leading Senate liberal Harkin of Iowa to retire

DES MOINES (Reuters) - Senator Tom Harkin, a veteran Iowa Democrat and one of the most liberal senators, said on Saturday he will not seek re-election in 2014, putting at risk what was considered a safe Democratic seat.

Harkin, 73, who has focused much of his nearly 40-year congressional career on farm policy, education and expanding rights for people with disabilities, is the third senator facing re-election next year who has announced his retirement, following Democrat Jay Rockefeller of West Virginia and Republican Saxby Chambliss of Georgia.

"It's somebody else's turn. It's time for me to step aside ... . I think that's not only good for our party, it's good for our state and for our nation," Harkin said in an interview with Reuters.

He said he had no health problems but had promised his wife that he would quit before it was too late to enjoy other things in life.

Iowa, site of the country's first presidential nominating contest, is considered a political swing state. Republican Charles Grassley is Iowa's other U.S. senator.

In remarks to the Iowa Democratic Party central committee after his announcement, Harkin said he would stay politically active.

"I'm not quitting today. This is not a time for legacy talks or anything like this," said Harkin, who has served in Congress since 1974.

Several committee members had tears running down their cheeks as he spoke.

President Barack Obama, a fellow Democrat, praised Harkin for his decades of public service.

"During his tenure, he has fought passionately to improve quality of life for Americans with disabilities and their families, to reform our education system and ensure that every American has access to affordable health care," Obama said in a statement.

Senate Majority Leader Harry Reid, a Nevada Democrat, in a statement described Harkin as "a passionate progressive, whose deeply held principles have provided a guiding light to Democrats for decades."

SEARCH IS ON

Party officials said Harkin's announcement, coming early in the current two-year election cycle, provides ample time to recruit a strong Democratic candidate.

Among Democrats, U.S. Representative Bruce Braley is widely seen as a front-runner. U.S. Agriculture Secretary Tom Vilsack, a former Iowa governor, and his wife, Christine Vilsack, who ran unsuccessfully for Congress last year, are also viewed as potential candidates.

Among Republicans, U.S. Representatives Tom Latham, a moderate, and Steve King, a conservative, are mentioned as possible candidates, which could produce a divisive Republican primary.

Obama won Iowa in the November election. But the state has a Republican governor, and a divided legislature and congressional delegation.

Harkin's retirement "just reinforces our belief that a grassroots Republican comeback can take place in 2014. Let's have it start in Iowa," Iowa Republican Party Chairman A.J. Spiker said in an email appeal to state Republicans.

The party needs to pick up six seats in the mid-term elections next year to get a majority in the 100-member Senate.

One of the last of the Senate's old-guard liberals, Harkin angrily opposed the White House over the recent fiscal cliff compromise that Vice President Joe Biden negotiated with Senate Republican leader Mitch McConnell of Kentucky.

Harkin said the deal that raised taxes only on the very rich helps the wealthy at the expense of the middle class.

First elected to the House of Representatives in 1974 and to the Senate in 1984, Harkin said someone younger needs to take his place.

"I've been there 40 years. I'm 73. By the time I run (for re-election), I'd be 75," he said.

Procter & Gamble fiscal 2Q profit jumps

(AP) ? Procter & Gamble's plan to cut costs and roll out new products is paying off.

The world's largest consumer goods company, whose products like Tide detergent and Gillette razors are in 98 percent of Americans' households, reported that its fiscal second quarter profit more than doubled as its new focus helped it gain market share and boost its bottom line.

Like many companies, Procter & Gamble has focused on growing in emerging markets China and India to drive growth as more developed regions like North America have slowed. But the company, based in Cincinnati, took for granted that it was a household name in some areas: It grew too fast and kept prices high. As a result, the company lost market share in more than half of its categories, while competitors gained ground.

But last year, P&G launched a massive restructuring plan that aimed to cut costs and focus on the company's most profitable products and geographies. The company also lowered prices for laundry detergent, toothpaste and other products in the U.S., and cut jobs.

The company's quarterly results show that the strategy is working. The company held or grew market share in businesses representing almost 50 percent of sales during the fiscal second quarter that ended in December.

The growth was driven in part by recent product launches that include 3D White toothpaste in Brazil and the introduction of a low-priced razor Gillette Guard in Egypt. In the U.S., Tide Pods drove the improvement in the detergent category and Cascade dish detergent, Gillette Fusion razors and Crest toothpaste were other strong sellers.

The company's cost-cutting measures also are contributing to the improved results. The company said its plan to cut 10 percent of its non-manufacturing jobs, or 5,700, by the end of the fiscal year is 95 percent complete, about four or five months ahead of schedule. It also plans to cut 2 to 4 percent more jobs per year in fiscal 2014 to 2016.

"We have more work to do, but the underlying trends are improving," said CFO John Moeller in a call with analysts. "We remain confident that our focus areas ... are the right ones, and should generate over time the kind of earnings progress that will put us among the best in our industry."

During the second quarter that ended Dec. 31, P&G earned $4.06 billion, or $1.39 per share, up from $1.69 billion, or 57 cents per share, in the same quarter last year. Excluding special items, it earned $1.22 per share. Revenue increased 2 percent to $22.18 billion. Analysts polled by FactSet expected earnings of $1.11 per share on $21.86 billion in revenue.

Based on the better-than-expected results for the first half of the year, P&G said it expects fiscal 2013 core earnings of $3.97 to $4.07 per share on revenue growth of 1 percent to 2 percent. It previously predicted an adjusted profit of $3.80 to $4 on flat revenue growth to up to 1 percent. Analysts expect earnings of $3.97 per share.

For the current quarter, the company projected core earnings of 91 cents to 97 cents per share on sales growth of 3 percent to 4 percent. Analysts expect a profit of 95 cents per share.

The results are welcome news for the company, which has faced ire from unhappy investors about its lack of market share growth, most notably from activist investor William Ackman, who disclosed a 1 percent stake in the company last July.

On the news, P&G shares rose $2.53, or 3.6 percent, to $72.94, after earlier reaching a 52-week high of $73.24

"We like that P&G is making progress on this front, and we are optimistic that this trend of improvement will continue, especially given that many of P&G's new product launches have just recently, or have yet to, hit the market," Wendy Nicholson, an analyst at Citi Investment Research, wrote in a note.

P&G's results come after its competitor Unilever on Wednesday reported that its full-year net income rose 5 percent, helped by higher prices and cutting costs.

The Dutch company, which makes consumer products such as Dove soaps and Magnum ice cream, recently has been outperforming its larger rival.

Dozens reported killed in Venezuela prison riot

CARACAS, Venezuela (AP) ? Venezuelan authorities promised a high-level investigation Saturday into a deadly prison riot that reportedly left dozens of people dead when National Guard soldiers clashed with armed inmates.

Vice President Nicolas Maduro called the violence tragic while speaking on television early Saturday and said Prosecutor General Luisa Ortega Diaz and National Assembly President Diosdado Cabello would lead the investigation. He and other officials didn't give a death toll from the riot Friday at Uribana prison in the central Venezuelan city of Barquisimeto.

"The prisons have to be governed by law," Maduro said.

Humberto Prado, an activist who leads the watchdog group Venezuelan Prisons Observatory, said inmates' relatives and media accounts put the toll at 55 killed and 88 injured.

The Venezuelan newspaper Ultimas Noticias and the television channel Globovision reported more than 50 killed, both citing Ruy Medina, the director of Central Hospital in the city.

Relatives wept outside the prison during the violence, and cried at the morgue Saturday as they waited to identify bodies.

Penitentiary Service Minister Iris Varela said Friday that the riot broke out when groups of inmates attacked National Guard troops who were attempting to carry out an inspection.

Varela said the violence had affected a number of prisoners and officials, but said the authorities would hold off until control had been re-established at the prison to confirm the toll. She said the government decided to send troops to search the prison after receiving reports of clashes between groups of inmates during the past two days.

The death toll provided by Medina rose late Friday after he had initially reported four killed and dozens injured. Ultimas Noticias reported that the victims included a Protestant pastor and a member of the National Guard, as well as inmates.

Opposition leader Henrique Capriles condemned the government's handling of the country's overcrowded and violent prisons.

"Our country's prisons are an example of the incapacity of this government and its leaders. They never solved the problem," Capriles said on his Twitter account. "How many more deaths do there have to be in the prisons for the government to acknowledge its failure and make changes?"

The Venezuelan Prisons Observatory said in a statement that in 2007 the Costa Rica-based Inter-American Court of Human Rights had ordered the government to seize weapons that inmates had in their possession at Uribana prison and to take measures to avoid deaths in the facility. The group called for the government to release a list with the names of the dead and wounded in Friday's violence, as well as details about weapons seized in the search.

"No one doubts that inspections are necessary procedures to guarantee prison conditions in line with international standards, but they can't be carried out with the warlike attitude as (authorities) have done it," Prado told The Associated Press in a telephone interview. "It's clear that the inspection wasn't coordinated or put into practice as it should have been. It was evidently a disproportionate use of force."

Prado's group says Uribana prison was built to hold up to 850 inmates but currently has about 1,400.

It was the latest in a series of bloody riots in the country's severely overcrowded prisons where inmates often freely obtain weapons and drugs with the help of corrupt guards. Venezuela currently has 33 prisons built to hold about 12,000 inmates, but officials have said the prisons' population is about 47,000.

In April and May, a prison uprising in La Planta prison in Caracas blocked authorities from going inside for nearly three weeks. One prisoner was killed and five people were wounded, including two National Guard soldiers and three inmates.

Two months later, another riot broke out at a prison in Merida, and the Venezuelan Prisons Observatory reported 30 killed.

In August, 25 people were killed and 43 wounded when two groups of inmates fought a gunbattle inside Yare I prison south of Caracas.

Chavez's government has previous pledged improvements to the prison system, but opponents and activists say the government hasn't made progress.

(AP) ? Activists with a big fake polar bear have occupied a Shell service station in the Swiss resort of Davos to protest Royal Dutch Shell PLC's oil drilling in the Arctic.

About 25 activists from around Europe chained gas pumps together Friday at the station near where the World Economic Forum was being held and hung a banner on the roof reading "Arctic Oil - Too Risky."

Greenpeace helped stage the protest, raising concerns about dangers to the environment from Shell's drilling in Alaska and urging forum organizers to reconsider Shell's participation. A Shell drill barge ran aground on a remote Alaska island on New Year's Eve.

Shell officials, among the 2,500 corporate and political leaders in Davos this week, did not immediately respond to phone calls about the protest.

news/high-country-foreclosure-figures-sentiment-not-good-the ...

Foreclosure By Jesse Wood

Jan. 25, 2013. Foreclosure filings for 2012 rose nearly 3 percent in the state over last year, according to statistics from the N.C. Administrative Office of the Courts.

The High Country ? Ashe, Avery and Watauga counties ? fared better in that category with nearly 500 foreclosure filings, representing an 8.5 percent decrease from 2011 and nearly equaling 2009 figures.

Last year, Avery and Ashe counties had double-digit declines, while filings in Watauga County were in line with state-as-a-whole figures and actually increased 5 percent.

Just because a foreclosure is filed doesn?t mean it will actually foreclose, so the exact totals are difficult to quantify, but speaking with veteran real estate agents in the High Country who track local foreclosures, the High Country had an increase in foreclosures for 2012.

Jim Dorman, owner of Castle Rock Realty in Banner Elk and a real estate agent for 46 years, noticed ?quite a few more foreclosures? in Avery County in 2012.?

?There?s a backlog pending that could choke a goat,? said Dorman, adding that he?s noticed foreclosure ? and non-foreclosure ? sales under $200,000 and over $750,000 ? but ?nothing going on? in between.

This pending backlog seems on par with last year.

In 2011, foreclosure filings in the state dropped in the 20-percent range over record-high totals in 2010, which was the year the bottom fell out of the real estate market everywhere. While the significant decline sounded encouraging, bank and real estate experts attributed the drop to a backlogged, lengthened foreclosure process.?

Eric Lanier, a real estate agent in the High Country, runs Lanier Management Tools, a company that tracks real estate statistics. Because he just recently began compiling data in Avery and Ashe counties, he only has historical foreclosure data for Watauga County.

According to his figures, Watauga County, in 2012, experienced a significant increase in actual foreclosures.

He noted that Watauga had 188 foreclosures this year on all kinds of properties that ranged from houses, town-homes, condominiums and land.

In 2011, 120 properties were foreclosed upon. That?s a 57 percent year-over-year increase.

Speaking generally about the near future of the overall real estate market ? not just including foreclosures, Lanier said, ?Well, I hate to be a pessimist. I don?t really see an indication to say it?s going to get any better.??

Te'o says he lied briefly after his fake girlfriend died (+video)

Manti Te'o says he lied after he knew is fake girlfriend was still alive.? Notre Dame linebacker Manti Te'o told Katie Couric in an interview to be aired Thursday that he lied about his Internet relationship to the media.

?Notre Dame linebacker Manti Te'o has told Katie Couric that he briefly lied about his online girlfriend after discovering she didn't exist, while maintaining that he had no part in creating the hoax.

Pressed by Couric to admit that he was in on the deception, Te'o said he believed that his girlfriend Lennay Kekua had died of cancer and didn't lie about it until December.

"Katie, put yourself in my situation. I, my whole world told me that she died on Sept. 12. Everybody knew that. This girl, who I committed myself to, died on Sept. 12," Te'o said in an interview to air Thursday on Couric's syndicated talk show. A segment of the interview with Te'o and his parents was broadcast Wednesday on "Good Morning America."

The Heisman Trophy runner-up said he only learned of the hoax when he received a phone call in December from a woman saying she was Kekua.

"Now I get a phone call on Dec. 6, saying that she's alive and then I'm going be put on national TV two days later. And to ask me about the same question. You know, what would you do?" Te'o said.

An Associated Press review of news coverage found that the Heisman Trophy runner-up talked about his doomed love in a Web interview on Dec. 8 and again in a newspaper interview published Dec. 10.

Te'o's father defended his son when Couric pointed out that many people don't believe the Irish star, suspecting he used the situation for personal gain.

"People can speculate about what they think he is. I've known him 21 years of his life. And he's not a liar. He's a kid," Brian Te'o said with tears in his eyes.

On Tuesday, the woman whose photo was used as the "face" of the Twitter account of Te'o's supposed girlfriend says the man allegedly behind the hoax confessed and apologized to her.

Diane O'Meara told NBC's "Today" show that Ronaiah Tuiasosopo used pictures of her without her knowledge in creating a fake woman called Lennay Kekua.

Netflix and YouTube's DIAL promises to be open alternative to AirPlay

It's already clear that most of us prefer watching Netflix on TV rather than on our PCs or tablets, but it appears the subscription video pioneer isn't content with just direct streaming. As we learned at CES 2013, Netflix is currently in cahoots with YouTube to build out a multiscreen initiative called DIAL (which stands for "discovery and launch") that could provide real competition for Apple's AirPlay. It works in essentially the same way -- DIAL lets you play streaming video on compatible TVs without having to launch the app first -- but there are a few key differences. Unlike AirPlay, DIAL lets you launch apps, even web apps, on the TV -- if it's a Smart TV, you'll even be redirected to download an appropriate app from its app store. However, it can't send URLs to the TV and mirror displays like AirPlay can, supposedly to avoid protocol conflicts as it builds its network of partnerships.

And that's where DIAL's growing momentum comes in. According to GigaOm, DIAL is an open protocol, which gives it massive dev and OEM appeal. All Google TV boxes already have it, while Sony, Samsung and LG are reportedly very interested. Scott Mirer, director of product management at Netflix, said the latter two have already incorporated it in some 2012 TVs, with more coming in the future. More important is the support from app devs and content providers -- BBC, Hulu, Pandora and Flingo have already signed up to take part in the effort, with Chrome purportedly working on DIAL compatibility for browser-to-TV page-flinging. On the whole, it's a promising path for not just Netflix and YouTube, which have previously only released relatively limited remote control applications, but the second screen movement in general.

Sheriff: New Mexico teen planned family shootings

ALBUQUERQUE, N.M. (AP) ? The New Mexico teen accused of killing his parents and three siblings is portrayed in charging documents as a boy haunted by homicidal and suicidal thoughts that included fantasies of killing his girlfriend's parents and gunning down random people at a Wal-Mart.

To his family, he was a bright and talented musician who played guitar, drums and bass with a church group. He also was a champion wrestler who dreamed of following his family's long tradition of military service, and a boy who accompanied his pastor father on rescue missions to Mexico.

In a statement issued Tuesday night on behalf of family, the boy's uncle Eric Griego described those traits, and called on the media and the public not to use 15-year-old Nehemiah Griego "as a pawn for ratings or to score political points."

"He is a troubled young man who made a terrible decision that will haunt him and his family forever," the statement said.

It gave no clue as to what might have prompted the alleged assault by the teen, who authorities say confessed to shooting his mother and three younger siblings in their beds early Saturday, then waiting in a bathroom with a military-style semi-automatic rifle to ambush his father upon his return from an overnight shift at a homeless shelter.

"Our family is heartbroken over this senseless tragedy," the statement said. "We have not been able to comprehend what led to this incredibly sad situation. However, we are deeply concerned about the portrayal in some media of Nehemiah as some kind of a monster."

The family noted they had no indication such a tragedy could happen, but said it's clear something went terribly wrong.

"Whether it was a mental breakdown or some deeper undiagnosed psychological issue, we can't be sure yet," the statement said. "What we do know is that none of us, even in our wildest nightmare, could have imagined that he could do something like this."

After killing his parents, younger brother and two sisters at the family's home in a rural area southwest of Albuquerque, Griego planned to randomly shoot people at a Wal-Mart, Bernalillo County Sheriff Dan Houston said Tuesday. The teen also contemplated killing the parents of his 12-year-old girlfriend, Houston said.

Griego loaded guns and ammunition into the family's van, but it was unclear if he ended up going to a Wal-Mart or how seriously he contemplated continuing his rampage, the sheriff said.

The attack happened Saturday, the same day thousands of gun advocates rallied around the country to oppose the gun-control measures proposed by President Barack Obama following the December elementary school massacre in Connecticut.

What authorities know, Houston said, was that Griego texted a picture of his dead mother to his girlfriend, then spent much of Saturday with the girl and her family. That evening, Griego went to the church where his father once worked, and he confessed later that night to killing his parents and three siblings, authorities said.

"We know Nehemiah had been contemplating this for some time," Houston said. Griego apparently had told others of his plans, but whom and when were still under investigation, the sheriff said.

The motive, Houston said, "was purely that he was frustrated with his mother."

"He did not give any further explanation," he said.

The teen waived his right to arraignment in adult criminal court Tuesday on charges of murder and child abuse resulting in death and was ordered held without bond. He was arrested Saturday at his family's home.

The sheriff's office identified the dead as Greg Griego, 51, his wife, Sarah Griego, 40, and three of their children: a 9-year-old boy, Zephania Griego, and daughters Jael Griego, 5, and Angelina Griego, 2.

The teen had no history of mental illness or run-ins with the law, and neither drugs nor alcohol appeared to be a factor, Houston said. The sheriff noted the teen liked violent video games such as "Modern Warfare" and "Grand Theft Auto," but he didn't say whether he believed the games were a factor.

Greg Griego was a gang member-turned pastor who had served at Calvary, one of Albuquerque's largest Christian churches. He had an extensive arrest record from his gang days, but was best known throughout the law enforcement community for his work as a volunteer chaplain.

The church planned a prayer vigil Wednesday night.

"We are doing what we can as a church body to minister to the remaining family members," Calvary Pastor Skip Heitzig said in a statement. "Only the Lord Jesus Christ can heal this type of pain and heartache."

Ten Questions to Ask a Plumber | HomeSpot HQ Blog

The best time to find a plumber is BEFORE we actually NEED one, but let?s face it, our home plumbing is an out-of-sight, out-of-mind type thing.? We won?t fix it until it?s broken, yet this often leaves us in an all-too-sticky situation.
We need a plumber now, and we need them to fix it fast!? ?Just get here,? no questions asked.? The problem ?is the difference between what can be a simple $65 to $100 job and what could end up being a $5,000 to $10,000 clean up.

Save yourself from the headaches, heartaches and pocketbook aches of having the wrong person do the job.? Before you hire a plumber, ask them these ten simple questions and you?ll be set!

plumber questions1.?????? Are you licensed and qualified to work in [your state name here]?

All plumbers are required by law to be licensed in their state of work.? You can check a plumbers license by going online (in most states) to your State Contractor License Board website and searching by the company?s name or license number.

2.?????? Are you insured and do you carry Workman?s Comp?

A plumber should carry adequate liability insurance to cover any job site damages as well as Workman?s Compensation to cover any job related injuries or health risks.? This information can also be found on most State Contractors License Board websites. If not, you can always request a certificate of liability and Workman?s Comp.

3.?????? Are you bonded?

Bonds are recommended for any work done over $500.? It is set in place to protect you if the terms of the contract are not met by your plumber.? You want to make sure that their bond will cover the entire cost of completing (or re-doing) any of the specified work.? You can also find this information on most State Contractors License Board websites as well.

4.?????? Do you offer free estimates?

Most plumbing companies DO offer free estimates, but some will actually charge a trip fee or a service charge which is generally non-negotiable and can be shocking if you are unaware of it, and they show up and don?t do any work.? So make sure to ask!

5.?????? How do you charge for your services? Hourly or fixed rate?

Most plumbing companies charge at a fixed rate.? The underlying hourly rate of a plumber is anywhere from $40 to $70 per hour, but by charging a fixed rate, they are using their expertise to know approximately how long the job will take them, in order to give you one flat price.? This is often better than hourly rates where some plumbers might abuse the hourly wages and prolong their visit just to make more money. Be careful here!

6.?????? (If it?s an emergency) Do you charge any additional fees for emergency service?

Emergency service is generally considered any service required outside of normal working hours (7am to 6pm for most companies) or service that would require immediate assistance thus causing a plumber to reschedule some of his previously scheduled work.? Emergency fees normally run between $100 to $175 and ARE pretty standard.

7.?????? Do you offer any warranties or guarantees on your work?

This category can be a little tricky.? Most plumbers DO offer warranties and guarantees on all of their work, however, if a plumber notices a deeper issue and makes a recommendation for you to fix it and you choose not to, generally they will not offer a warranty or guarantee on that item or service.? The logic is simple, they know it will fail again and they are warning you for a reason.

8.?????? Do you have any references?

Although this is a great question to ask, often times you can look them up online on sites like Google Plus Local, Yellow Pages Online or Yelp (and you definitely should).? Keep an open mind when it comes to these websites ?and use your better judgement. A company with fifteen 5-star reviews and one 2-star review is probably a good bet.? A company with one positive review and two negative reviews probably isn?t worth your time.

9.?????? Do you have a website?

A good plumbing company WILL have a website and it generally outlines all of their terms and conditions and/or their service guarantees.? Bonus: It might also have some good coupons or deals for services that plumbers aren?t all to obliged to let you know about.

10.?? When?s the soonest you can be here? OR can you work with my schedule?

Most plumbing companies can have a tech out the same day during regularly scheduled business hours (generally 7am to 6pm for most companies) and/or can schedule appointments that work around your schedule. A plumbing company that can?t or won?t work with you is not worth your time.

So next time, when you find yourself in need of plumbing, make sure to ask these ten questions before hiring a plumber. Otherwise, you might regret it!

Good grief! Charlie Brown voice actor arrested

Alberto E. Rodriguez / WireImage file

Voice actor Peter Robbins and Charlie Brown attend the DVD release for "You're Not Elected, Charlie Brown" in Hollywood on Oct. 7, 2008.

By Randee Dawn, TODAY contributor

The onetime voice of Charlie Brown in the animated "Peanuts" TV series was arrested on Sunday on five felony charges, NBC News confirms.

Peter Robbins has been charged with four felony counts of making a threat to cause death or great bodily injury, and a single felony count of stalking. After being booked in San Diego just after 3:30 a.m. local time on Monday, he was held on $550,000 bail. He is scheduled for arraignment on Wednesday.

The San Diego Union-Tribune reported that Robbins was arrested on Sunday evening as he crossed into the United States from Mexico at the San Ysidro Port of Entry. He was alone in his 2006 Mercedes-Benz C230 when a border officer pulled him aside for an examination. During that check, the officers learned he was wanted by the San Diego Sheriff's Department on a felony warrant for crimes against a person, said a U.S. Customs and Border Protection representative.

During an interview at San Diego's Comic-Con, Robbins, 56, said he'd begun as the original voice of Charlie Brown when he was 9 (video below). He voiced several "Peanuts" TV specials and films, including "A Charlie Brown Christmas," "It's the Great Pumpkin, Charlie Brown" and "A Boy Named Charlie Brown." When he reached 14, "it was time to move on," he said in that interview. His acting career also included roles on shows like "My Three Sons" and "F Troop."

Robbins' manager told the Union-Tribune that she was unable to discuss his arrest at the time, but planned to comment later Wednesday.
